Acceptance of Terms

By accessing or using the Rescover website (the “Site”) and related services (collectively, the “Services”), you and your organization acknowledge that you have read, understood, and agree to be bound by these Terms of Use (“Terms”). If you do not agree, please discontinue use of the Site.

Changes to Terms

We may modify these Terms from time to time. When we do, we will post the updated version with a new “Last Updated” date. By continuing to use the Site after any modifications, you accept the revised Terms.

Eligibility and Account Creation

  • Eligibility: You must be at least 18 (or the legal age of majority in your jurisdiction) to use the Site.
  • Accurate Information: If you create an account or submit information, you agree to provide true, accurate, current, and complete information about yourself and/or your organization, and to update that information as needed.
  • Account Responsibilities: You are responsible for safeguarding any login credentials and for all activity under your account. Rescover reserves the right to refuse or terminate accounts if information is inaccurate or if there is any violation of these Terms.

User Conduct and Posting Rules

  1. Prohibited Content: You and your organization may not upload, transmit, or post any content that:
    • Is unlawful, fraudulent, defamatory, obscene, pornographic, profane, threatening, hateful, or otherwise objectionable.
    • Encourages conduct that would constitute a criminal offense or otherwise violates any local, state, national, or international law.
    • Contains viruses, worms, or any other harmful or destructive code.
    • Infringes or violates any patent, trademark, trade secret, copyright, or other proprietary rights.
    • You do not have the legal right to make available (e.g., confidential or proprietary information).
  2. Unsolicited Communications: You and your organization may not post chain letters, pyramid schemes, investment opportunities, spam, or any form of unsolicited commercial communication.
  3. Right to Remove Content: Rescover has no obligation to monitor content but reserves the right to refuse, remove, or modify any content at any time, for any reason, in its sole discretion.

Use of the Site and Services

  1. No Guarantee of Availability: You acknowledge and agree that you must provide for your own access to the Site, including internet service, hardware, and software. Rescover is not responsible for the performance of your hardware, software, internet service provider, or any other third parties.
  2. Modifications: We reserve the right to modify or discontinue the Site or any Services, temporarily or permanently, at any time without notice.

Intellectual Property

  1. Rescover Content: All content, trademarks, and logos on the Site (other than user-generated content) are owned by or licensed to Rescover and are protected by applicable laws. You agree not to copy, distribute, or create derivative works from any Rescover-owned content without explicit permission.
  2. User-Generated Content: Rescover does not claim ownership of the data or content you or your organization submit. However, by submitting content, you grant Rescover a worldwide, irrevocable, royalty-free, and non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, transmit, publicly display, publicly perform, sublicense, create derivative works from, and transfer such data or content for the purpose of operating and improving the Services.
    • No Sale of Data: Rescover will not sell your personal data or contact information to third parties.

Financial Information Disclaimer

Any financial information, analyses, or other content provided through the Site is for informational purposes only. Rescover is not an investment adviser, and no content on the Site constitutes professional or financial advice. You assume sole responsibility for any decisions or actions you take based on the information provided.

Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, RESCOVER DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  1. ACCURACY AND COMPLETENESS: Any warranties concerning the availability, accuracy, or usefulness of information.
  2. NON-INFRINGEMENT AND TITLE: Warranties that the Site or its content do not infringe third-party rights.
  3. MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE: Warranties that the Site or any data provided will meet your requirements or achieve particular results. Rescover also disclaims liability for damages related to delays, interruptions, errors, network or system outages, file corruption, or service interruptions caused by performance issues in your hardware or third-party systems.

Limitation of Liability

To the maximum extent permitted by law, neither Rescover nor its employees, agents, affiliates, or service providers shall be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the Site or Services, even if advised of the possibility of such damages. Your sole and exclusive remedy is to discontinue using the Site.

Indemnification

You agree to defend, indemnify, and hold harmless Rescover and its affiliates from any and all claims, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site or Services.
  • Any content you (or users of your account) submit, post, or transmit.
  • Your violation of these Terms or infringement of any rights of another.

Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You and Rescover agree to submit to the personal and exclusive jurisdiction of the courts located in Montgomery County, Texas for any disputes arising from or related to these Terms.

Severability and Waiver

If any provision of these Terms is held invalid by a court of competent jurisdiction, the remainder of the Terms shall remain in full force and effect. Rescover’s failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Termination

These Terms are effective as of the date you first access or use the Site and remain effective until terminated by you or by Rescover. Rescover may terminate your access to the Site or remove your data or content at any time, for any reason, without notice.
